10 Minute Madness Prize Draw Terms and Conditions

This 10 Minute Madness Prize Draw Competition (the “Competition”) is run by bwin.party marketing (Gibraltar) Limited (“bwin”). By playing the 10 Minute Madness Game (the “Game”) and/or clicking your acceptance of these Terms and Conditions (the “Terms”) you are entering into a legally binding agreement with bwin. This promotion will run from 6th December 2012 to 15th May 2013.

1. Game Rules

1.1. Pick any Euroleague game on any match day and in each quarter select the team which you think will score the most points during that quarter.

1.2. If you successfully pick the higher scoring team during that quarter you will be awarded the following points:
Your team scores the most points: 100 points
Both teams score the same points: 50 points
Your team loses the quarter: 0 Points

1.3. In the final fourth quarter of the game you can elect to play ’10 Minute Madness’ or continue to play the game as normal.

1.4. In ’10 Minute Madness’, if you select the correct team, you will double the total number of points which you have won in the previous three quarters. If however you select the wrong team you will not score any points for that quarter and you will lose all of the points you won in previous quarters.

1.5. Bonus point questions may be asked at any time during the game. You will have a limited time to answer these questions. If you answer these questions successfully you will be awarded with bonus points:

1.6. Bonus points:
High risk questions answered correctly: 50 points
High risk questions answered incorrectly: -25 points
Low risk questions answered correctly: 25 points
Low risk questions answered incorrectly: 0 points

2. Prize Competition

2.1. At the end of the game, all players who have scored more than 25 points will be invited to enter into the prize draw.

2.2. In order to be eligible for the prize draw, you must:

2.2.1. be over eighteen (18) years of age;

2.2.2. complete the entry form which appears at the end of the game with true and accurate information about yourself;

2.2.3. click the check box confirming that you have read and agreed to these terms and conditions; and

2.2.4. be willing to participate in any related publicity campaigns for the promotion of the bwin brand.

3. Prizes

3.1. Prize draws will be divided into the following territories: (i) Russia, (ii) Greece, (iii) Italy, (iv) Spain and (v) Rest of World (the “Territories”). Separate prize draws will take place for each of the Territories and those winners in each Territory will be awarded prizes on the terms set out below.

3.2. The number of points you win during a game will denote which prize levels you will be placed in (the “Prize Level”).

3.3. At the end of each match day, you will be placed in a prize draw with other people in your Territory who achieved the same Prize Level as set out in the table below.

3.4. You are entitled to play the game as many times as you like and will receive an entry into the prize draw each time you play. If however two or more matches are being played at the same time you must choose which match you wish to play and will not be entitled to enter the prize draw through both games.

3.5. If you are awarded a prize, you will be contacted via the contact details you provide. Failure to acknowledge your acceptance of the prize within the specified timeframe will result in forfeiture of the prize, and bwin being entitled to re-draw.

3.6. Prizes may include:

3.6.1. Final 4 Courtside Tickets: (circa 1.800 EUR)

3.6.2. Final 4 Courtside Tickets: (circa 1.000 EUR)

3.6.3. Spalding Basketball: (circa 50 EUR)

3.6.4. Jersey: (circa 70-90 EUR)

3.6.5. Grandstand Tickets: (circa 25-40 EUR)

4. General

4.1. bwin reserves the right to modify these terms, or the structure of the competition at any time with or without reason. You are advised to read these terms every time you enter the prize draw.

4.2. bwin reserves the right to suspend or cancel any individual prize draw immediately, in any of the territories where for any reason, or no reason, without notice.

4.3. bwin reserves the right to exclude entrants from the Competition and/or to take any course of action available to bwin, where bwin at its sole discretion, reasonably believes there has been a breach of these Terms. The actions which will result in bwin excluding you from the Competition may include but will not limited to:

4.3.1. failure to abide by these Terms;

4.3.2. any attempt to corrupt the game in any way; and/or

4.3.3. any attempt to defraud bwin.

4.4. Where any player is excluded from the competition they will no longer be eligible to win the prize.

4.5. All decisions made by bwin in relation to exclusion from the Competition are final and no correspondence will be entered into.

4.6. The prizes shall have no cash value and no substitute will be awarded. If you are unable to accept the prize, you must notify bwin and will have to forfeit the prize.

4.7. Where bwin.com bonus codes are awarded to prize winners, these bonuses will be subject to the bwin terms and conditions relating to bonus available at www.bwin.com.

4.8. If you are a Gold and Silver level prize winners and are awarded tickets to a Euroleague match:

4.8.1. You cannot transfer the tickets to any third party without bwin’s prior permission (prize winners may be required to show proof of identification and failure to provide valid identification may result in you being refused entry to the stadium);

4.8.2. you are responsible for your own cost of travel;

4.8.3. you are responsible for your own insurance and any other expenses;

4.8.4. you must abide by the terms and conditions of the Euroleague and any the stadium where the match is taking place;

4.8.5. any minors attending the Euroleague match must be accompanied by a parent or guardian.

4.9. Officers, directors, employees, consultants or agents of bwin.party digital entertainment plc or AKQA or any of their group companies will not be eligible to participate in the prize draws.

5. Intellectual Property

5.1. You acknowledge and accept that all trademarks, commercial names or logos, and all industrial and intellectual property rights, relating to the content of the website, is owned by or licensed to bwin. Under no circumstances shall access to the service imply any kind of waiver, transfer, licence or assignment of said rights, in whole or in part.

5.2. The Terms of Service confer on you no right to use, alter, exploit, reproduce, distribute or publicly display the content of the website in any way other than expressly provided for in these Terms.

5.3. Any other use or exploitation of any rights shall be subject to the prior and express written authorisation specifically granted for that purpose by bwin or the third party who holds the rights concerned.

6. Privacy Policy

6.1. bwin may, in accordance with these Terms and Conditions, collect information and/or personal data, including but not limited to, your name, gender, date of birth, residential address, email address, phone number or other contact information and certain technical information (the "Information").

6.2. By entering the prize competition, you are authorising bwin to collect, store and use your Information.

6.3. By entering the prize competition, you are authorising bwin to use your Information for marketing purposes in relation its betting, gaming and social games products and services.

6.4. Your Information will be stored in our database in accordance with applicable laws and will only be disclosed or deleted at your express request or by law.

6.5. bwin may provide your Information to any third party partners providing it with services, including but not limited to, payment processing, data analysis, email delivery, hosting services, customer service and to assist bwin in its marketing efforts.

6.6. You may contact Us at Suite 6, Atlantic Suites, Europort Avenue, Gibraltar if you: (i) want to confirm the accuracy of the Information bwin holds about you; (ii) would like to update your Information; and/or (iii) have any complaint regarding Our use of Your Information.

6.7. Information collected may be stored and processed in any country in which bwin or its affiliates, suppliers, ESPs or agents maintain facilities. You expressly consent to any transfer of Information outside of your country (including to third countries that may not have been assessed as having adequate privacy laws).

7. Cookies

7.1. By accessing the website and entering the prize competition, you are authorising bwin to use server log files, web log files, web-bug, tracking technologies and cookies to collect certain technical information to (i) analyse usage of the services; (ii) provide a more personalised experience; (iii) recognise the location and the device being used to access the website, (iv) deliver adverts to you on other websites, and (iii) allow us to improve the quality of the service. A cookie is a small text file recorded on your hard drive that identifies you as a unique user and contains certain information about your particular login session and/or your use of the website. Please note that companies delivering advertisements within the Services may also use cookies or other technologies, and those practices are subject to their own policies.

8. Disclaimer / Limitations / Waivers of Liability

8.1. Your access to the website and use of the 10 Minute Madness game is at your sole option, discretion and risk. You expressly agree that the services are provided on an "as is" basis without warranties of any kind, either express or implied, including but not limited to, warranties of title or implied warranties of non-infringement, merchantability or fitness for a particular purpose (except only to the extent prohibited under applicable law with any legally required warranty period to the shorter of thirty (30) days from first use or the minimum period required).

8.2. You specifically acknowledge that bwin and AKQA are not liable to you for the acts or omissions of our third parties and the risk of injury from third parties is entirely with you.

9. Governing Law

9.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Gibraltar.

9.2. These terms are originally drafted in English. Where they translated into another language, in the event of a conflict, the England language will prevail.

9.3. You irrevocably agree to submit to the exclusive jurisdiction of the courts of Gibraltar for settlement of any disputes or matters arising out of or concerning these Terms of Service or their enforceability. The 10 Minute Madness game and the website is not a real money gaming or sports betting website and as such is not subject to locally applicable gambling legislation.
